Terms & Conditions

These terms explain the rules for using our quote request pages, submitting a form, and communicating with WhiteStone Communications.

Please note before you read onSection 11 contains a binding arbitration clause and a class action waiver that affect how disputes between us are resolved. You can opt out of it within 30 days.

01Acceptance and eligibility

These Terms & Conditions are an agreement between you and WhiteStone Communications (“WhiteStone,” “we,” “us” or “our”). By using our website or quote request pages, submitting a form, calling us or replying to a text message, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use our pages or submit a request.

You must be at least 18 years old and able to enter a binding contract. Our quote request services are offered to residents of the United States only. WhiteStone Communications is registered in the State of Wyoming, with its office at 30 N Gould St, Ste N, Sheridan, WY 82801, USA.

Where we provide services to a business under a separate signed agreement, that agreement governs, and these terms apply only where they do not conflict with it.

02What we do and what we do not do

We operate marketing pages and quote request forms. When you submit a request, we review it and refer it to one or more licensed insurance agents, agencies or carriers who may contact you about the coverage you asked about. We may be compensated for that referral.

  • We are not an insurance company and do not underwrite or issue any policy.
  • We do not provide quotes or rates. Only a licensed agent or an insurer can quote you.
  • We do not make coverage decisions. Underwriting, eligibility and pricing are decided entirely by the insurer.
  • We are not affiliated with or endorsed by any government agency, including Medicare, the Centers for Medicare & Medicaid Services or the Social Security Administration.

We do not guarantee that an agent will contact you, that any product will be available to you, or that any quote will be at a particular price. We do not control what an agent says to you after your details are transferred.

03The information you submit

When you submit a request, you confirm that the information is true and complete, that the phone number is yours and you are authorized to consent to calls and texts at that number, that you are submitting the request for yourself, and that you are 18 or older.

Please do not send a Social Security number, Medicare Beneficiary Identifier, bank or payment card number, or medical records through our forms. We may reject any request that appears inaccurate, duplicated, automated or submitted without valid consent.

04Consent to be contacted

When you check the consent box, you give prior express written consent for WhiteStone Communications and the licensed insurance agents, agencies and carriers we work with to contact you at the phone number you provided, including a wireless number, about the coverage you asked about. You agree these contacts may use an automatic telephone dialing system, prerecorded, artificial or AI-generated voice messages, and text messages, even if your number is on a federal or state do-not-call registry.

Your consent is not a condition of purchasing any goods or services. Message and data rates may apply, and message frequency varies.

You may withdraw consent at any time. Reply STOP to any text, ask an agent on a call to add you to our do-not-call list, use the unsubscribe link in any email, email info@whitestonecommunication.com, or call 509-768-2249. We act on withdrawal requests promptly. If an agent already has your details, please ask them directly as well, since they keep their own lists. We keep a record of the consent you gave, as described in our Privacy Policy.

05Call recording

Calls to and from our contact center may be recorded and monitored for quality, training and compliance. You will be told this at the start of the call, and continuing the call means you consent. If you do not consent, tell the agent and the call will end. Federal Medicare rules require sales and enrollment calls to be recorded in full, so recording cannot be turned off on those calls.

06No insurance advice

Everything on our pages is general information provided for marketing purposes. It is not insurance, legal, tax, financial or medical advice, and it is not a recommendation that any product is right for you. Benefits, availability, rates and underwriting rules vary by state, age, health, carrier and enrollment period, and they change over time.

We strive to keep information on our pages accurate and current, but we do not guarantee that it is complete or up to date. Speak with a licensed agent and read the policy documents before making a decision. Do not cancel existing coverage until replacement coverage has been issued and is in force.

07Medicare notices

We do not offer every plan available in your area. Any information we provide is limited to those plans we do offer in your area. Please contact Medicare.gov, 1-800-MEDICARE (TTY users call 1-877-486-2048), or your local State Health Insurance Program (SHIP) to get information on all of your options.

This is a solicitation for insurance. By submitting a Medicare quote request, you agree that a licensed insurance agent may contact you, and you understand that your information will be provided to a licensed insurance agent who may call you about Medicare plan options.

WhiteStone Communications is not connected with or endorsed by the United States government or the federal Medicare program. Enrollment in a plan is generally limited to certain times of year unless you qualify for a Special Enrollment Period.

08Acceptable use

You agree not to:

  • Submit false or fraudulent information, or another person’s details without their authority.
  • Use bots, scrapers or other automated tools on our pages.
  • Attempt to gain unauthorized access to, or interfere with, our systems.
  • Send malware or spam, or frame our pages or alter how they appear without our written consent.
  • Use our pages for any unlawful purpose or in violation of telemarketing, consumer protection or advertising laws.

We may suspend access and report conduct to the appropriate authorities if these terms are violated.

09Our content and third parties

Unless otherwise stated, our pages and all content, text, graphics, design, code, logos and trademarks on them are owned by WhiteStone Communications or our licensors, and all rights are reserved. You may view and print pages for your personal, non-commercial use. You may not republish, sell, rent, sublicense, reproduce or redistribute our content, or use our name, logo or branding, without our prior written permission. Other names and marks belong to their respective owners.

Our pages may link to websites we do not operate, and your request may be transferred to independent insurance agents and carriers. We are not responsible for their content, services, pricing, licensing or conduct. Any dealings you have with them are solely between you and them.

10Disclaimers and liability

Our pages and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that our pages will be accurate, current, secure or uninterrupted, and we make no warranty about any agent, carrier or product referred to on them.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of profits, revenue, business or data, or for damages arising from reliance on content on our pages. Our total liability for all claims will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars ($100). We are not liable for the acts of any insurance agent or carrier, for any policy sold to you, or for any claim that is denied.

Some states do not allow these exclusions or limitations, so parts of this section may not apply to you. Nothing in these terms waives a right that cannot be waived under state or federal law, or excludes liability for fraud.

You agree to indemnify and hold harmless WhiteStone Communications and its owners, officers, employees and agents from any claim or cost arising from your violation of these terms or any law, or from information you submitted that was false or that you were not authorized to submit.

11Arbitration and class action waiver

Please read this section carefully. It affects your legal rights. It requires most disputes to be resolved through binding individual arbitration instead of in court, and it waives your right to a jury trial and to participate in a class action.

Talk to us first. Before starting arbitration, send written notice to info@whitestonecommunication.com describing the dispute and the relief you are seeking. We will do the same. We both agree to try in good faith to resolve the dispute within 60 days.

Arbitration. If we cannot resolve it, any dispute relating to these terms, our pages or our services will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. The arbitration will be conducted in English by written submissions, by videoconference, or in the county where you live, at your choice. The Federal Arbitration Act governs this section.

Individual basis only. You and WhiteStone each waive the right to a jury trial and to bring or participate in a class, collective or representative action. If this waiver is found unenforceable for a particular claim, that claim alone will proceed in court and all other claims will remain in arbitration.

Exceptions. Either of us may bring an individual claim in small claims court, or ask a court for an injunction to protect intellectual property or stop unauthorized access to our systems.

How to opt out. Email info@whitestonecommunication.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these terms. Include your name and the phone number you used. Opting out does not affect any other part of these terms.

12Governing law

These terms and any dispute relating to them are governed by the laws of the State of Wyoming and applicable United States federal law, without regard to conflict of law rules. Where section 11 does not apply, you and WhiteStone agree to the exclusive jurisdiction of the state and federal courts located in Wyoming.

Nothing in these terms takes away mandatory consumer protections under the law of your state of residence, or your right to bring an individual claim in small claims court. Our pages are directed to users in the United States, and we make no representation that they are appropriate for use elsewhere.

13General

  • These terms and the Privacy Policy are the entire agreement between us about our pages and services.
  • If any provision is found unenforceable, it will be severed and the rest will remain in effect.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign your rights under these terms. We may assign ours in connection with a merger, reorganization or sale of assets.
  • We are not liable for delays or failures caused by events beyond our reasonable control.
  • Sections 6, 9, 10, 11, 12 and 13 survive any termination of these terms.
  • Under California Civil Code Section 1789.3, California residents may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.

14Changes and contact

We may update these terms at any time. The “Last updated” date at the top shows when the current version took effect, and we will post notice on our pages before a material change takes effect. Continuing to use our pages after an update means you accept the revised terms.
